Challenging and Enforcing ISDS Awards in ICSID and UNCITRAL Arbitrations

About the Event: 

Investor-State arbitral tribunals are being constituted for resolving disputes between investors and states for alleged violation of investor’s rights under investment treaties. Numerous concerns have been raised regarding the legitimacy of the existing system in the face of divergent results on cases which deal with the same legal issues and substantially similar facts. The appealing mechanisms have been in the center of attention.
 
The lecture will cover the very controversial matter of appealing the rendered awards under different arbitration institutions and rules and will also concentrate on the interference of the domestic law of the seat of arbitration in appealing procedures.
 

About the Speaker: 

Ara Papyan is a Ph.D. candidate at the University of Lausanne (Switzerland) focused on international investment arbitration. Papyan is a legal advisor with a strong international economic law background. His areas of specialization include WTO law and dispute settlement, international investment law, EU internal market law, and external relations law. Until recently Papyan has been a chief legal officer at “SPS Cigaronne” LLC, managing complex matter of accessing foreign markets, including tariff and non-tariff measures and compliance in highly complex jurisdictions. He is experienced in tobacco, mining and resources industries, and is currently an associate fellow at Yerevan-based independent research institute (AIISA). Papyan holds LL.M. degree from University of Lausanne focused on international and European economic law.
